Appeal from a judgment entered in the United States District Court for the Western District of New York pursuant to Fed. R. Civ. P. 54(b), Richard J. Arcara, Judge, dismissing on statute-of-limitations grounds certain claims alleging personal injuries resulting from toxic substances transported to and maintained in a Cheektowaga, New York landfill. Cross-appeal seeking affirmance on the ground that the federal statute relied on by plaintiffs, altering the starting date of state-law limitations periods applicable to claims of injury caused by hazardous wastes, see 42 U.S.C. § 9658, is unconstitutional under the Commerce Clause and the Tenth Amendment. See In re Pfohl Brothers Landfill Litigation, 26 F.Supp.2d 512 (1998), 68 F.Supp.2d 236 (1999).
